1. What Is the “Spouse of Japanese National” Visa?

The “Spouse of Japanese National” visa is granted to foreign nationals who are legally married to a Japanese citizen.To obtain and maintain this visa, the holder must continue to meet the following primary requirements.

①The Actual Marital Relationship

Individuals eligible for this visa are those who hold the legal status of being the spouse of a Japanese national. In this context, “spouse” refers exclusively to a person who is currently in a valid marital relationship. Those whose Japanese spouse has passed away or who have divorced are not included.

(2) Continuation of living together

To maintain this visa, the couple is generally required to live together, unless there is a reasonable and legitimate reason for living apart.

③Financial Stability

A stable financial foundation for living in Japan must be secured. Immigration authorities will examine whether the applicant or their spouse has sufficient income, as well as whether they possess adequate savings.

①Termination of the Marital Relationship (Divorce or Death)

If the marital relationship ends due to divorce or the death of the Japanese spouse, the foreign national holding a “Spouse of Japanese National” visa loses the very basis for that status. As a result, once the marriage no longer exists, the visa can no longer be legally renewed.

②Living Separately After Marriage

Living together as a married couple is a fundamental requirement for maintaining this visa. If the authorities find the couple’s living arrangements unclear, it can directly lead to a denial. Even in cases where the couple is temporarily living apart due to work or academic reasons, insufficient supporting evidence may result in a negative assessment. Furthermore, even if the couple has not divorced, prolonged separation can make it difficult to renew the visa.

3. Advantages of Obtaining Permanent Residency at early stage

If you obtain permanent residency, you can eliminate the risks mentioned above and continue living in Japan regardless of the status of your marriage. Permanent residency does not require renewal, and there are no restrictions on living or working in Japan. Although changing to a “Long-Term Resident” visa after divorce or the death of a spouse is one possible option, the application and renewal processes involve uncertainty. In contrast, securing permanent residency significantly reduces future risks and anxiety. For this reason, it is generally advisable to apply for permanent residency as soon as you meet the eligibility requirements.

4. Special Exceptions to the Required Period of Stay for Permanent Residency Applications

One of the general requirements for obtaining permanent residency is having lived in Japan for at least ten years. However, for those holding a “Spouse of Japanese National” visa, a special exception applies:the applicant may qualify if they have maintained a genuine marital relationship for at least three years and have lived continuously in Japan for at least one year.
